Legitimacy of licensing of towage and maneuvering operations in Ukraine
In 2013, the Ministry of Infrastructure of Ukraine has approved the new License terms to exercise commercial activity on rendering of services on transportation of passangers, dangerous goods, luggage by inland water and maritime transport. According to the license terms towage and maneuvering operations shall also be subject to license, that directly contradicts the Law of Ukraine "On Licensing Certain Types of Commercial Activities". About situation in the field of regulation of legal relations in the sea port (review of the Law of Ukraine "On Sea Ports of Ukraine" and delegated legislation)
On June 13, 2013, the Law of Ukraine On Sea Ports of Ukraine came into force. In this regard, the article considers the conceptual changes that occur in connection with the adoption of this law, and issues of the current situation of legal relations in the sea port. It is indicated that the current law provides the possibility to privatize facilities of port infrastructure, with the exception of strategic facilities, or to carry out private investment by means of concession, joint venture, lease or other investment treaty.
